Terms of Use

By creating an account, accessing, or using the FinEdu application ("App") or website ("Site") — collectively the "Service" — you ("User") agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and any additional terms applicable to specific features or plans. If you do not agree, do not use the Service.

You must be at least 13 years of age to use the Service. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

These Terms constitute a legally binding agreement between you and FinancialEdu Inc., an Arizona C Corporation ("Company," "we," "us," or "our").

To access most features, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information;
• Keep your password confidential and not share it with any third party;
• Immediately notify us of any unauthorized access or security breach at support@thefinedu.com; and
• Accept responsibility for all activity that occurs under your account credentials.

We reserve the right to suspend or terminate accounts that provide inaccurate information, violate these Terms, or engage in prohibited conduct.

Email and password;

Sign in with Apple (iOS); and

Sign in with Google.

When you use a third-party sign-in method (Apple or Google), your use of that method is also governed by the applicable third-party terms of service and privacy policy. We receive only the information necessary to authenticate your account as described in our Privacy Policy.

You must confirm that you are 13 years of age or older at registration. Users who are found to be under 13 will have their accounts immediately deactivated and their data deleted. We do not knowingly allow children under 13 to use the Service.

Subject to your compliance with these Terms, FinancialEdu Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes (or, for institutional users, for your organization's authorized educational or employee wellness purposes).

Copy, modify, distribute, sell, or lease any part of the Service;

Reverse engineer, decompile, or attempt to extract the source code of the Service;

Create derivative works based on the Service; or

Use the Service to build a competing product or service.

Structured learning modules covering personal finance, investing, budgeting, credit, taxes, and related topics;

Interactive mini games that reinforce financial literacy concepts;

Placement assessments to set your personalized learning level;

Streaks, XP rewards, and achievement badges to encourage consistent learning; and

Personalized financial news content powered by Finlight, adjusted to your learning level.

FinEdu offers the following financial tools, all of which are live and available within the Service:

• Budget Planner — plan and track income and expenses;
• Paycheck Calculator — estimate take-home pay after taxes and deductions;
• Net Worth Tracker — calculate assets minus liabilities;
• Investment Growth Calculator — project investment returns over time;
• Compound Interest Calculator — model the effect of compound interest;
• Loan Repayment Calculator — estimate monthly payments and total interest;
• Emergency Fund Calculator — determine your recommended emergency fund target;
• Debt Payoff Planner — model debt payoff strategies (avalanche and snowball);
• Retirement Savings Calculator — project retirement savings and income;
• Cost of Living Comparison Tool — compare cost of living across cities;
• Savings Goal Tracker — set and track progress toward savings goals;
• Credit Score Simulator — understand how financial decisions may affect credit;
• Tax Estimator — estimate federal income tax liability;
• Rent vs. Buy Calculator — compare the financial implications of renting versus buying; and
• Insurance Needs Estimator — estimate recommended insurance coverage levels.

These tools are for educational and planning purposes only. They do not constitute financial, tax, investment, insurance, or legal advice. Results are estimates based on the information you provide and assumptions built into each tool.

The Service includes "FinAI," an AI-powered financial literacy assistant:

FinAI is powered by Google Gemini Flash and provides general financial education only — not personalized financial advice.

Do not make financial decisions based solely on FinAI responses. FinAI may contain errors. Always consult a qualified financial professional for personalized guidance.

FinEdu includes a simulated paper trading feature that allows you to practice investing using real market price data (provided by Alpaca Markets) and virtual XP currency:

• No real money is involved at any time — all trades are fully simulated;
• XP currency used in paper trading cannot be exchanged for real money, securities, or any items of real-world monetary value;
• No real brokerage account is created through FinEdu;
• Market price data is provided for educational simulation purposes only and may not reflect exact real-time conditions; and
• Paper trading performance does not predict or guarantee results in real investing.

FinancialEdu Inc. is not a broker-dealer, registered investment adviser, or licensed financial professional. The paper trading feature is offered solely as an educational tool.

Daily streak reminders;

Lives/Wads of Cash refill alerts;

Learning encouragement nudges; and

Account and subscription-related notices.

You may opt out of push notifications at any time through your device's notification settings. Note that disabling all push notifications will also disable functional notifications (such as lives refill alerts).

Additional lives may be purchased via the Lives Refill in-app purchase ($0.99).

The following in-app purchases are available:

• Lives Refill — $0.99 (one-time): immediately refills your Wads of Cash lives;
• XP Booster — $2.99 (one-time): multiplies XP earned for a set period;
• Custom Course Builder — $14.99 (one-time): unlocks the ability to create custom learning courses; and
• Advanced Courses — $14.99 (one-time): unlocks access to advanced-level learning content.

In-app purchases are processed by Apple (iOS) or Google (Android) depending on your device. Web purchases are processed by Stripe. All purchases are final and non-refundable except as required by applicable law or as described in Section 8 (Refunds).

FinEdu offers institutional plans for schools, businesses, credit unions, nonprofits, and other organizations:

• Starter (Free): Up to 10 users, core modules, basic admin dashboard;

Subscriptions renew automatically unless cancelled before the renewal date;

You may cancel at any time through App Store settings (iOS), Google Play settings (Android), or your FinEdu account settings (web);

Cancellation takes effect at the end of the current billing period; and

We will notify you before any price changes take effect, in accordance with Section 22.

We may offer a free trial period for Premium features. At the end of the trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends. Trial eligibility, duration, and applicable terms will be stated at the time of enrollment.

All purchases made through the Apple App Store or Google Play Store are subject to those platforms' refund policies. FinancialEdu Inc. does not process refunds for App Store or Google Play purchases. To request a refund for these purchases, contact Apple Support (apple.com/support) or Google Play Support (support.google.com/googleplay) directly.

For web-based subscriptions and purchases processed by Stripe:

One-time purchases: Generally non-refundable once the purchase is complete; and

Refund requests must be submitted within 30 days of the transaction date. After 30 days, all sales are final.

Cancellation of a subscription ends access to Premium features at the end of the current paid period. No partial-month or partial-year refunds are provided upon cancellation, except during the 7-day new subscriber window described above.

The Service allows you to input personal financial data into financial tools, create custom courses (Premium/one-time purchase), and interact with FinAI. Any information or content you submit ("User Content") remains yours. By submitting User Content, you grant FinancialEdu Inc. a limited, non-exclusive license to use that content solely to provide you with the Service.

You are solely responsible for the accuracy of User Content. We do not verify, endorse, or assume liability for any User Content.

Use the Service for any unlawful purpose or in violation of any applicable law or regulation;

Circumvent, disable, or interfere with security features of the Service;

Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or our systems;

Scrape, crawl, or systematically extract data from the Service without our written permission;

Upload or transmit viruses, malware, or other harmful code;

Impersonate any person or entity or misrepresent your affiliation with any person or entity;

Interfere with or disrupt the integrity or performance of the Service or its infrastructure;

Attempt to reverse engineer the Service or any of its components; or

Use the Service to harass, harm, or collect information about other users.

Violation of these prohibitions may result in immediate account suspension or termination and, where appropriate, legal action.

All content, features, and functionality of the Service — including the FinEdu name and logo, curriculum content, mini games, software, design, text, and graphics — are the exclusive property of FinancialEdu Inc. or our licensors and are protected by U.S. and international intellectual property laws.

Nothing in these Terms transfers ownership of any intellectual property to you. The limited license granted in Section 3 does not include any right to use our trademarks, logos, or brand elements without our prior written consent.

All content within FinEdu — including lessons, assessments, FinAI responses, financial tools, news content, and paper trading features — is provided for general educational and informational purposes only and does not constitute:

• Financial advice;
• Investment advice or recommendations;
• Tax advice;
• Legal advice; or
• Any other professional or regulated advice.

Always consult a qualified financial professional, tax adviser, attorney, or other relevant professional before making any financial, investment, tax, or legal decisions. FinancialEdu Inc. is not responsible for any financial decisions or outcomes based on the content or tools provided in the Service.

The Service integrates with or links to third-party services including Apple, Google, Stripe, Finlight, and Alpaca Markets. These integrations are governed by the respective third parties' terms of service and privacy policies. FinancialEdu Inc. is not responsible for third-party services, their content, privacy practices, or availability.

The inclusion of a link or integration does not imply our endorsement of the third party.

FinEdu may be used in educational settings subject to the Family Educational Rights and Privacy Act (FERPA). When FinEdu is used in such settings:

• FinancialEdu Inc. acts as a "school official" with a "legitimate educational interest" as defined under FERPA when operating under an institutional agreement with a FERPA-covered institution;
• We will not disclose student education records without the consent of the eligible student or parent/guardian, except as permitted by FERPA; and
• Students and parents/guardians retain their rights under FERPA to inspect and review education records and to request corrections.

Institutions using FinEdu under FERPA must execute a Data Processing Agreement or similar agreement with FinancialEdu Inc. that addresses FERPA compliance obligations. Contact info@thefinedu.com for more information.

The Children's Online Privacy Protection Act (COPPA) applies to the online collection of personal information from children under 13. FinEdu does not permit users under 13 to create accounts, and we do not knowingly collect personal information from children under 13. Users who are found to be under 13 will have their accounts deactivated and data deleted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FINANCIALEDU INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINANCIALEDU INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless FinancialEdu Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you submit.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Before initiating arbitration, you agree to contact us at info@thefinedu.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, either party may initiate arbitration.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including its formation, interpretation, breach, or termination — shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona, or via videoconference if permitted. The arbitrator's decision shall be final and binding.

YOU AND FINANCIALEDU INC. EACH AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution by arbitration. Small claims court actions within the applicable jurisdictional limits are also exempt from arbitration.

You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing info@thefinedu.com with the subject "Arbitration Opt-Out." Opting out does not affect any other provisions of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. For any dispute not subject to arbitration under Section 19, you and FinancialEdu Inc. consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.

We may suspend or terminate your access to the Service at any time, with or without cause, upon notice to you. You may terminate your account at any time through app settings or by contacting support@thefinedu.com. Upon termination:

• Your right to access the Service ceases immediately;
• Purchased in-app items are forfeited (subject to applicable refund rights); and
• Sections 11, 12, 16, 17, 18, 19, 20, and 23 survive termination.

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document;
• Display a prominent in-app notice for at least 14 days; and
• For significant changes, send email notice to registered users.

Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may close your account.
