1. Who We Are & Acceptance of Terms
These Terms of Use ("Terms") are a legally binding agreement between you ("User," "you," or "your") and FinancialEdu Inc. ("Company," "we," "us," or "our"), governing your access to and use of the FinEdu mobile application and website (collectively, the "Service").
FinancialEdu Inc. is a C Corporation. "FinEdu" is a registered trade name (DBA) of FinancialEdu Inc. All legal rights and obligations under these Terms belong to FinancialEdu Inc.
By downloading, installing, accessing, or using the Service, you confirm that you:
- Meet the applicable age requirement described in Section 3;
- Have read, understood, and agree to be bound by these Terms and our Privacy Policy;
- Have the legal capacity to enter into a binding agreement, or if you are a minor, have obtained verifiable parental or guardian consent as described herein; and
- If acting on behalf of an institution, have full authority to bind that institution to these Terms.
2. About FinEdu
FinEdu is a gamified financial literacy platform that helps users learn personal finance through interactive learning modules, quizzes, an AI-powered chatbot (FinAI), curated financial news (FinNews), financial calculation tools, and simulated paper trading. FinEdu is an educational tool only.
FinEdu does not provide financial advice, investment advice, tax advice, or legal advice. Nothing in the Service constitutes a recommendation to buy, sell, or hold any financial product or security. Users should consult a qualified licensed professional before making real financial decisions.
3. Eligibility & Age Requirements
3.1 Users 13 and Older
Users who are 13 years of age or older may create an account and use the Service. Users between the ages of 13 and 17 represent that a parent or legal guardian has reviewed and agreed to these Terms on their behalf.
3.2 Users Under 13 — Verifiable Parental Consent Required (COPPA)
FinEdu may permit users under the age of 13 to use the Service only after receiving verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. The following process applies:
- A parent or legal guardian must complete our parental consent flow during account registration on the child's behalf before the account is activated;
- We collect and verify parental consent using a method that reasonably ensures the person providing consent is the child's actual parent or legal guardian;
- Before consent is given, parents receive a full description of what information we collect from the child and how it is used;
- After consent is given, the parent or guardian may at any time: (a) review all personal information collected from the child; (b) direct us to delete that information; and (c) refuse to permit further collection or use of the child's information;
- Consent may be revoked at any time by contacting us at info@thefinedu.com with the subject line "Parental Consent Revocation";
- Children under 13 will have access to a restricted version of the Service with certain features limited or disabled; and
- We will not condition a child's participation in the Service on disclosing more personal information than is reasonably necessary.
Parents and guardians: please review our Privacy Policy for a complete description of what we collect from users under 13 and how that information is used and protected.
3.3 Account Registration
All users must register for an account to access most features. You agree to:
- Provide accurate, current, and complete information at registration, including your full legal name, email address, date of birth, and phone number;
- Promptly update your account information if it changes;
- Keep your password confidential and not share it with any other person;
- Notify us immediately at support@thefinedu.com if you suspect unauthorized access to your account; and
- Accept full responsibility for all activity that occurs under your account.
3.4 One Account Per User
Each individual may hold only one personal account. Creating multiple accounts to circumvent restrictions, suspensions, or subscription limitations is prohibited and may result in permanent termination of all associated accounts without refund.
4. Subscription Plans & Payments
4.1 Free Tier
FinEdu offers a free tier that includes access to core learning modules, basic financial tools, limited daily FinAI tokens (5 per day), and ad-supported content. No payment is required for the free tier.
4.2 Premium Subscription
Premium subscriptions are available at the following rates:
- Monthly Plan: $6.99 per month, billed each month; or
- Annual Plan: $59.99 per year, billed as a single upfront charge (equivalent to approximately $5.00 per month).
Premium subscribers receive expanded FinAI daily token access, an ad-free experience, increased Wads of Cash (lives), personalized FinNews impact analysis, and the full financial tools suite. Prices are subject to change with at least 30 days' written notice to existing subscribers before any increase takes effect.
4.3 In-App Purchases (IAP)
The following items are available for individual purchase within the app:
- Wads of Cash (lives) refill packs — $0.99 per pack;
- Avatar cosmetics, XP boosters, and limited digital items — prices vary and are displayed at point of purchase; and
- Advanced Courses (e.g., Day Trading, Options Trading, Real Estate Investing, Starting a Business, and others as added) — $14.99 per course, one-time purchase.
All in-app purchases are final and non-refundable except as required by applicable law or the applicable app store's own refund policy.
4.4 Institutional Plans
FinEdu offers institutional plans for schools, businesses, credit unions, nonprofit organizations, and other entities. Institutional plans are billed to the institution on an annual basis. Students always access the platform for free — institutions pay for administrative tools and features only. The following tiers are available:
- Starter (Free): $0 per year. Includes 1 active course, up to 5 modules per course, and up to 20 students. Basic enrollment view only. No analytics dashboard or data export. Suitable for teachers evaluating the platform;
- Standard: $79 per institution per year. Includes 1 class per teacher account (maximum 30 students per class), full analytics dashboard, student data export, bulk student import, class broadcast notifications, weekly teacher digest email, school name co-branding, sequential learning paths, completion certificates, and email support with 48-hour response;
- Professional: $199 per institution per year. Includes everything in Standard, plus: the ability to customize your own course ($149 one-time add-on per course), multi-class management, progress reports to parents, shared course library across teachers, engagement and attendance tracking, classroom game mode, private FinHub class channel, and paper trading class monitor (Summer 2026 features); and
- Enterprise: Custom pricing. Includes everything in Professional, plus: district rollup dashboard, LMS grade passback (Canvas, Google Classroom, Schoology), parent/guardian portal, full white-label branding, HR and compliance documentation reports, SSO integration, 99.5% uptime SLA, multi-year discounts, and a dedicated account manager.
Nonprofit organizations with 501(c)(3) status are eligible for discounted institutional rates: Standard at $59 per year and Professional at $99 per year. Nonprofit status must be verified at signup.
All institutional plan pricing is subject to change with at least 30 days' written notice to existing institutional account holders, except as provided in Section 12.4 regarding multi-year contract pricing.
4.5 Payment Processing
Payments are processed by Apple In-App Purchase (iOS), Google Play Billing (Android), and Stripe (web transactions). FinancialEdu Inc. does not store credit card numbers, bank account details, or full payment instrument information. All payment processing is subject to the terms and privacy policies of the applicable processor.
4.6 Automatic Renewal & Cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. To cancel:
- iOS: Settings > [Your Name] > Subscriptions;
- Android: Google Play app > Subscriptions; or
- Web: FinEdu account settings > Subscription > Cancel.
Cancellation takes effect at the end of your current paid billing period. You retain Premium access through the end of that period. No partial refunds are issued for unused subscription time unless required by law.
4.7 Refund Policy
All purchases are generally final. Refund requests for web platform purchases must be submitted within 48 hours of the transaction to support@thefinedu.com. Refunds are at our sole discretion except where required by law. Purchases made through Apple or Google must be refunded directly through those platforms per their respective refund policies.
5. XP, Wads of Cash & Virtual Items
FinEdu uses an in-app experience point (XP) system and a virtual lives mechanic called "Wads of Cash." You acknowledge and agree that all virtual items, including XP, Wads of Cash, avatar cosmetics, and earned badges:
- Have no real-world monetary value and cannot be withdrawn, transferred, or exchanged for cash, except through limited, explicitly announced sponsor reward programs;
- Are licensed to you, not sold — you do not own virtual items;
- May be adjusted, limited, modified, or discontinued at any time without compensation;
- Are non-transferable between accounts;
- Are forfeited without compensation upon account suspension or termination; and
- Accumulate subject to system limits that may change over time.
Any XP-to-reward redemption programs (such as gift card exchanges through sponsor partnerships) will be subject to separate program terms announced at launch and subject to stated eligibility requirements.
6. User Conduct
As a condition of using the Service, you agree not to:
- Use the Service for any purpose that violates applicable local, state, national, or international law or regulation;
- Attempt to gain unauthorized access to any account, server, system, or network associated with the Service;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app or its components;
- Upload, transmit, or introduce viruses, malware, spyware, or any other harmful or disruptive code;
- Harass, bully, threaten, stalk, defame, or cause harm to any other user or person;
- Post or transmit content that is obscene, offensive, discriminatory, illegal, or violates any third-party rights;
- Impersonate another person, entity, or FinancialEdu Inc. employee or representative;
- Use automated bots, scrapers, crawlers, or other automated means to access, collect, or extract data from the Service;
- Circumvent any paywall, content filter, rate limit, age gate, or security mechanism;
- Use the Service or any of its content for commercial purposes without our express prior written permission; or
- Use FinEdu to advertise, solicit, or promote competing financial education products or services.
Violations may result in immediate account suspension or permanent termination, with or without prior notice, at our sole discretion.
7. User-Generated Content
Community features including forums and peer discussion are anticipated for Summer 2026. Until those features are launched, this Section establishes the terms that will govern user-generated content (UGC) when available. When UGC features are live:
- You retain ownership of content you create but grant FinancialEdu Inc. a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to host, display, distribute, modify, and use your content within and in promotion of the Service;
- You represent that you own or have all necessary rights to grant this license and that your content does not infringe any third-party intellectual property, privacy, or other rights;
- You agree not to post content that is illegal, harmful, harassing, defamatory, misleading, or in violation of these Terms;
- We may remove any user content at our sole discretion at any time without notice or liability; and
- You are solely responsible for your content and all consequences arising from it.
8. FinAI Chatbot — Limitations & Disclaimers
FinAI is an AI-powered educational chatbot integrated into the Service, powered by Google's Gemini Flash model. By using FinAI, you acknowledge and agree that:
- FinAI responses are generated by artificial intelligence and may contain errors, inaccuracies, or outdated information;
- FinAI is designed for general financial literacy education only and does not provide personalized financial, investment, tax, or legal advice;
- No FinAI response should be relied upon as a substitute for advice from a qualified financial, tax, or legal professional;
- Daily token limits apply per account tier and are subject to change with notice; and
- FinancialEdu Inc. is not liable for any decision made in reliance on FinAI output.
9. Financial Tools — Disclaimer
FinEdu's financial tools (including the Budget Planner, Paycheck Calculator, Lease vs. Finance Calculator, Debt Payoff Calculator, and others) are provided for educational and illustrative purposes only. Results generated by these tools:
- Are estimates based solely on the inputs you provide and do not account for all real-world variables;
- May not accurately reflect your actual financial situation, applicable taxes, fees, or legal obligations;
- Should not be used as the sole basis for any financial, purchasing, or legal decision; and
- Carry no guarantee of accuracy, completeness, or fitness for any particular purpose.
10. FinNews — Third-Party Content
FinNews delivers AI-summarized financial news sourced from Finlight and other third-party data providers. You acknowledge that:
- All underlying news content is authored and owned by third parties — we do not author, verify, or independently endorse the original articles;
- AI-generated summaries are educational paraphrases and may not perfectly represent the original source material;
- FinNews complexity levels (Beginner / Intermediate / Advanced) are educational aids, not investment-grade analysis; and
- Nothing in FinNews constitutes investment advice, and FinancialEdu Inc. is not liable for any decision made based on FinNews content.
11. Paper Trading (Anticipated Summer 2026)
FinEdu anticipates launching a simulated paper trading feature using XP as virtual trading currency. You understand in advance that:
- Paper trading involves entirely simulated transactions — no real money is used and no actual securities are purchased or sold;
- Simulated performance does not reflect actual market conditions and has no predictive value for real-world trading results;
- FinancialEdu Inc. is not a registered broker-dealer, investment adviser, or securities exchange — paper trading is an educational simulation only; and
- This feature will be subject to additional terms published at the time of launch.
12. Institutional Accounts
Organizations using FinEdu's institutional features agree to the following additional terms, which supplement the general Terms of Use:
12.1 Compliance with Applicable Laws
- The institution is solely responsible for ensuring its use of the Service complies with applicable education privacy laws, including FERPA, COPPA, and applicable state student privacy statutes including but not limited to SOPPA (Illinois) and SOPIPA (California);
- Student performance data accessed through the admin dashboard may be used only for legitimate educational or HR purposes and may not be commercially sold, licensed, or used for any unrelated purpose;
- The institution must obtain all necessary parental or guardian consents for student users under 13 (COPPA) and for users between 13 and 17 as required by applicable state law; and
- Each institution is solely responsible for the security of its administrator login credentials.
12.2 Institutional Data Ownership
As between FinancialEdu Inc. and the Institution, the Institution retains all ownership rights to: (a) student and employee performance data generated through use of the Service; (b) course content created by the institution using FinEdu's course tools; and (c) any other data entered into the platform by the institution, its instructors, or its enrolled users. FinancialEdu Inc. processes this data solely to provide the Service and does not assert any ownership interest in Institutional Data. FinancialEdu Inc.'s use of Institutional Data is governed by this Agreement and our Privacy Policy.
12.3 Administrator Account Transfer
Notwithstanding the non-transferability provision in Section 22, Institutional Accounts may transfer administrator access to a designated successor administrator by providing written notice to info@thefinedu.com. The transferring administrator must identify the successor in writing. FinancialEdu Inc. will process the transfer within 5 business days of receiving written notice. This provision applies to all institutional tiers and does not require a new subscription agreement.
12.4 Multi-Year Contract Pricing
Institutions that commit to a multi-year subscription at the time of purchase are eligible for the following discounts off the then-current annual institutional rate:
- 2-year commitment: 10% discount applied to each year of the contract; and
- 3-year commitment: 15% discount applied to each year of the contract.
Multi-year pricing requires payment of the first year at signing. Discounts are non-transferable and apply only to the account and tier covered by the original agreement. If the institution downgrades tiers during a multi-year term, the discount applies to the new lower tier rate.
12.5 Post-Cancellation Data Export
Upon cancellation of a paid Institutional Account (Standard, Professional, or Enterprise), the institution will retain read-only access to its account data for a period of 90 days following the cancellation effective date, solely for the purpose of exporting student, employee, or participant data and course records. After this 90-day period, all Institutional Data will be deleted in accordance with our standard data retention policy as described in the Privacy Policy. FinancialEdu Inc. will send a reminder notice 14 days before the export window closes.
12.6 Enterprise Service Level Agreement
Enterprise tier customers under a separate Enterprise Agreement are entitled to the following service level commitment: FinancialEdu Inc. commits to 99.5% monthly uptime availability of the FinEdu platform. Uptime is measured on a calendar-month basis, excluding: (a) scheduled maintenance windows communicated at least 48 hours in advance; (b) force majeure events; and (c) outages caused by third-party service providers outside our reasonable control.
In the event of an uptime breach, the institution will receive a pro-rated service credit equal to 1/30th of the monthly equivalent fee for each calendar day the platform is unavailable beyond the 99.5% threshold. Service credits are the institution's sole remedy for uptime failures and must be claimed within 30 days of the applicable month.
The SLA in this Section applies only to Enterprise tier customers under a separate Enterprise Agreement. Standard and Professional tier accounts are not covered by an uptime SLA, though we commit to commercially reasonable efforts to maintain service availability.
12.7 General Institutional Obligations
- Course content created by an institution through FinEdu's course builder remains the institution's intellectual property. FinancialEdu Inc. retains a license to host and deliver that content through the platform for the duration of the institutional agreement;
- We reserve the right to suspend or terminate institutional accounts that violate these Terms, applicable law, or the terms of any separate institutional agreement; and
- Institutions are responsible for ensuring that enrolled students and employees acknowledge and comply with these Terms of Use.
13. Intellectual Property
13.1 Ownership
All content, features, and functionality of the Service — including course materials, software, graphics, illustrations (including the characters Fin and Ed), the FinEdu name and logo, trademarks, quiz content, and financial tools — are the exclusive property of FinancialEdu Inc. and are protected by U.S. and international copyright, trademark, and intellectual property laws.
13.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only. This license does not include the right to:
- Reproduce, copy, distribute, or publicly display our content outside the app;
- Create derivative works based on our content, characters, or course materials;
- Use our name, trademarks, logos, or characters without express prior written permission; or
- Commercially exploit any portion of the Service or its content.
14. Advertising
Free tier users will be shown advertisements served by third-party networks including Google AdMob. By using the free tier, you consent to the display of third-party ads. Premium subscribers are not shown advertisements.
Rewarded video advertisements — which users voluntarily choose to watch in exchange for in-app benefits such as Wads of Cash refills — are available to all users. Initiating a rewarded ad is entirely voluntary.
Users under the age of 18 will only be shown non-personalized advertisements, in compliance with applicable regulations and Google's Families Policy.
15. Third-Party Services
The Service integrates with third-party services including Google (Gemini AI, AdMob, Firebase, Google Play), Apple (App Store, In-App Purchase), Stripe, Finlight, Mixpanel, and Sentry. Your use of these services is subject to their respective terms and privacy policies. FinancialEdu Inc. is not responsible for the content, practices, or availability of any third-party service.
16. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, title, or non-infringement. FinancialEdu Inc. does not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) defects will be corrected; or (c) the Service or its servers are free from harmful components.
17. Limitation of Liability
To the maximum extent permitted by applicable law, FinancialEdu Inc. and its officers, directors, employees, shareholders, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, or goodwill — arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the greater of: (a) the total amount you paid us in the 12 months preceding the claim; or (b) one hundred dollars ($100.00).
18. Indemnification
You agree to defend, indemnify, and hold harmless FinancialEdu Inc. and its officers, directors, employees, shareholders, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.
19. Termination
We may suspend or terminate your account at any time, with or without cause and with or without notice, including for violations of these Terms. Upon termination:
- Your right to access and use the Service immediately ceases;
- Any unused XP balance, Wads of Cash, virtual items, or remaining subscription time is forfeited without compensation;
- Account data will be handled in accordance with our Privacy Policy; and
- Sections 5, 13, 16, 17, 18, and 20 will survive termination.
You may request account deletion at any time via app settings or by emailing support@thefinedu.com.
20. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration proceedings shall be conducted in Maricopa County, Arizona.
CLASS ACTION WAIVER: YOU AND FINANCIALEDU INC. EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
21. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this document;
- Notify registered users via in-app notification and/or email at least 14 days before changes take effect for paid subscribers; and
- For changes affecting users under 13, obtain fresh parental consent where required by COPPA.
For Institutional Accounts on Standard, Professional, or Enterprise plans, FinancialEdu Inc. will provide written notice of automatic renewal no less than 60 days prior to the renewal date, in recognition of institutional budget and procurement cycles.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.
22. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy and any additional feature-specific terms, constitute the entire agreement between you and FinancialEdu Inc. regarding the Service.
Severability: If any provision is found to be unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment: You may not assign your rights under these Terms. FinancialEdu Inc. may assign its rights and obligations to a successor entity in connection with a merger, acquisition, or sale of assets.
